1. Your agreement with us

These Terms of Use are an agreement between you and oof.gg, inc., based in Miami, Florida, United States (“we,” “us,” or “our”), covering Neonkick, our Twitch extension, and the related game website at play.oof.gg (the “Service”). Please read them before playing. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Questions and legal notices may be sent to developer@oof.gg.

Our Privacy Notice explains how we handle personal information. It does not ask you to waive privacy rights or give consent to processing where separate consent is required.

2. Eligibility and Twitch

You must be at least 13, meet any higher minimum age required by applicable law, and be eligible to use Twitch. If you are below the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and permit your use. A person accepting for a company or channel must have authority to do so.

Twitch authentication and identity access are required for certain features, including account-linked participation and saved progress. Keep your Twitch account secure and promptly report suspected unauthorized use. You are responsible for activity you authorize through your account. Do not share credentials with us.

Twitch is a separate provider. Its Terms of Service, community rules, and applicable Bits policies also govern your use of Twitch. Neonkick is operated by oof.gg, inc.; Twitch does not operate this game or become a party to these Terms.

3. Permission to use the game

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable permission to access and use the Service for its intended gameplay and channel features. Broadcasters may display, stream, and record ordinary gameplay and monetize their broadcasts through lawful platform features, subject to third-party rights and platform rules.

The Service, code, designs, and game assets belong to us or our licensors, except for content and rights owned by others. This permission does not transfer ownership. Third-party names and trademarks remain their owners’ property. Do not copy, resell, distribute, or commercially exploit the Service or its assets outside the permissions above, or reverse engineer it except where applicable law permits.

4. Fair play and acceptable use

Do not cheat, exploit bugs for an unfair advantage, manipulate rankings or purchases, use unauthorized automation, impersonate others, harass or threaten people, or submit unlawful or rights-infringing content. Do not bypass authentication or restrictions, intercept another person’s data, interfere with the Service, or probe systems without permission. Ordinary game controls, supported accessibility tools, and use permitted by law remain allowed. Report suspected security issues privately to developer@oof.gg.

Channel owners may manage their channels within supported features and platform rules. Their choices do not authorize conduct prohibited here. Rankings and results are for entertainment; they do not create an entitlement to money, prizes, sponsorship, or continued placement.

5. Cosmetics, Bits, and virtual items

Core gameplay is free. Optional cosmetics or effects may be offered free or through Twitch Bits. The available product, price, and scope of an unlock are shown before an authorized purchase. Some unlocks may be specific to a Twitch account and channel. Availability can change; an item shown as unavailable cannot be purchased through that feature.

Virtual items grant a limited right to use the applicable feature in the Service. They are not money, investments, or property redeemable for cash, and cannot be transferred or resold unless we expressly enable it. There is no wagering or promise of financial return. Purchases do not give an unfair gameplay advantage.

Twitch handles Bits acquisition and its transaction process under its own rules. For an undelivered or incorrect item, contact us with the transaction details; do not send payment credentials. Twitch’s refund rules and any mandatory consumer cancellation, refund, or conformity rights continue to apply. Nothing here removes a refund or other remedy required by law. We do not guarantee that any particular virtual item or the Service will remain available forever.

6. Your information and content

You retain any rights you have in information or content you provide. You grant us permission to host, process, transmit, and display it only as needed to operate, secure, and provide the Service, including displaying player names, cosmetics, gameplay, scores, and rankings to participants and viewers. You must have the rights needed to provide it.

Gameplay in a Twitch channel may be public, streamed, or recorded by others. Consider that visibility before participating. Our Privacy Notice explains account information, browser storage, retention, and how to request access or deletion. This permission does not override that notice or your rights under applicable privacy law.

7. Changes, availability, and suspension

We may update game balance, features, supported devices, and regional capacity, or perform maintenance. Connections, queues, rankings, and saved progress may be affected by outages or errors. We do not promise uninterrupted access, a particular connection quality, or permanent preservation of every result.

We may restrict or suspend access to address violations, security risks, legal requirements, or operational needs. Where reasonably possible and legally permitted, we will explain a restriction and give an opportunity to contact us about an error. Urgent safety or security issues may require immediate action. You can stop using the Service at any time and request deletion as described in the Privacy Notice.

If we discontinue the Service or materially remove paid functionality, we will provide reasonable notice where practicable and honor remedies required by applicable law. Provisions that by their nature apply afterward, including ownership, outstanding obligations, and dispute provisions, continue after access ends.

8. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or meet every device or connection requirement. These exclusions do not affect statutory consumer guarantees or any warranty that cannot lawfully be excluded.

9. Responsibility and limits

To the extent permitted by law, neither we nor our licensors are liable for indirect, incidental, special, or consequential losses, or lost profits, arising from use of the Service. Our aggregate liability arising from the Service or these Terms is limited to the greater of US $100 or the amount you paid to us for the Service in the 12 months before the event giving rise to the claim.

These limits do not exclude or limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer remedy that cannot legally be excluded or limited. Where your local law does not allow a particular exclusion or limit, that part does not apply.

10. Governing law and disputes

Florida law governs these Terms, excluding its conflict-of-laws rules, except that mandatory protections under the law of your place of residence continue to apply. Unless applicable law gives you the right to bring a claim elsewhere, courts with jurisdiction in Miami-Dade County, Florida will hear disputes concerning these Terms or the Service.

Please contact developer@oof.gg to try to resolve a concern. This request does not prevent you from seeking urgent relief or exercising any legal right. These Terms do not require arbitration or waive any right to participate in a class action where that right exists.

11. Changes to these Terms and other provisions

We will post revised Terms with an updated date and provide reasonable advance notice of material changes, unless a change must take effect sooner for legal or security reasons. Material changes apply prospectively. Where required, we will obtain renewed agreement. If you disagree with revised Terms, stop using the Service before they take effect.

If a provision cannot be enforced, the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver. These Terms govern your use of the Service, together with any product-specific terms clearly presented and accepted for a particular feature; third-party platform agreements remain separate. Contact oof.gg, inc., Miami, Florida, United States at developer@oof.gg for support or legal notices.
